Terms & Conditions

“The client(s)” shall be those persons defined in the booking form.  In the following terms & conditions “the photographer” shall mean Chloe Sellers trading as Golden Moon Photography.  It is mutually agreed that the following terms of agreement form an integral part of this contract and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.  By booking with the photographer, you agree to the below Terms and Conditions.

Copyright

All copyright of photographic images belongs to the photographer.  The photographer will aim to keep these images safe from any malicious activity but cannot be held liable or accountable for malicious actions carried out by persons other than Golden Moon Photography.

Photographers Use of Content

The client(s) hereby allow(s) the photographer to display any photographic images covered by this contract and to generally promote the business in advertising, brochures, magazine articles, calendars, websites, photo competitions, sample albums, commercial photography, etc.

The client(s) also consent to any promotional video content taken at the booked session and allow(s) this to be shared online for marketing purposes. 

If the session has been booked with the intent of purchased images being gifted / used for product launch material, etc.  the client(s) must advise on their client form a date in which content from the session is able to be shared from and the photographer shall withhold posting any material obtained from the session until the disclosed date. 

Clients Use of Images 

Online
When uploading images onto the web (Social Media), the client(s) will be required to only use the small resolution digital image with logo/watermark.  The client(s) are not permitted to remove the logo/watermark or edit the images (changing colours, or removing part of the image).  High resolution images without a logo/watermark are for printing purposes only.  The client(s) cannot enter any of the images into competitions (online or otherwise). 

Printing
When purchasing prints, the client(s) cannot scan the print into another print or a digital image.  The digital images can be purchased separately from the photographer. 

Welfare

It is the client’s responsibility to tell the photographer if they feel that the location or situation may put their pet or family member in danger. If the client’s dog needs to stay on the lead or cannot do certain things (for medical or other reasons) the client(s) will need to inform the photographer. If the client’s animal is aggressive it is also required that this is mentioned to the photographer to enable safety for all.

The photographer has the right to stop the session if they are concerned about the client(s) and / or subjects welfare, safety or behaviour during the session (no refunds provided).

Studio Accessibility

Access to the studio does require mobility via steps and we are unable to offer accessibility ramps to our studio due to spacing limitations.  Should a session be booked or gift voucher purchased and later cancelled due to accessibility being required, we are unable to offer any refunds.  

Prices

All services and/or goods are supplied at the current prices ruling at the time of each individual payment and are subject to change without prior notice. 

Session Payment, Postponement & Cancellation

A fee of £25 is required at the time of booking.  This secures the client’s date and time.

The appointment can be amended up to 10 working days before the session.  The client(s) are entitled to a maximum of one appointment change up to 10 working days before the session, after which they will lose the £25 booking fee.  Booking fees are non-transferable and non-refundable. 

The remaining balance of the client(s) session is required 72-hours prior to the appointment. 

If the client(s) notifies the photographer less than 72-hours prior to the appointment and requests postponement due to exceptional circumstances, the photographer must confirm in writing if this request will be fulfilled.  The photographer has every right to deny the request and no refunds will be issued. 

If for any reason the client(s) fails to attend their appointment without notification, the client(s) will lose their full fee. 

If Golden Moon Photography has to cancel the appointment for reasons beyond their control (death, injury, sickness etc.), their liability shall be limited to a full refund of all monies paid.

If the appointment has to be cancelled by Golden Moon Photography due to adverse weather conditions, a new, mutually agreed appointment will be made with no additional charge.

Printing/Products

The client’s chosen products from the client gallery will be ordered once payment for these products are cleared.  The client(s) are not entitled to a refund of the session if they do not wish to purchase any images.  Once an order has been placed, it cannot be cancelled, amended or refunded.  Products will be ready to pick up at the photographer’s studio within a reasonable timescale (up to 6 weeks from order date) once received from the supplier. 

Digital Files

When the client(s) purchase(s) digital files, the client(s) is/are responsible for keeping them safe and to make duplicates.  Any request for additional image duplicates from the photographer may incur additional charges. Digital files are provided as JPEG only, edited in the photographers style.

Golden Moon Photography will keep the client(s) images on file for a minimum of six months, after which the images may be deleted. 

Refund Policy

The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format.  No exception can be made, as the photographer cannot be held accountable for individual tastes or exceptions of the client(s).

Cooperation

The Photographer is not responsible if client(s) and/or key individual(s) fail to cooperate during sessions, or for missed images due to details not revealed to Photographer. 

Complaints

Any complaints should first be raised by the client(s) with the photographer in writing within 14 days from the date of receipt of images.  

Correspondence

All contact details will be held on file by the photographer.  The photographer can continue to send email communication to the client(s) further to the project being completed.  The client(s) will be able to unsubscribe from any marketing material at any given time.  

The photographer reserves the right to amend these terms and conditions without prior notice
